Appellate Law
The experience you need for the best outcome
Dissatisfied with the outcome of a recent trial? Or looking to preserve a judgment in your favor? Our Appellate practice group is here to help you obtain the fair outcome you deserve by appealing or defending your case in a higher court. On appeal, we advocate zealously on your behalf by persuading higher courts to reverse, modify, or affirm your final judgment.
Appellate attorneys seek to correct errors of lower courts and change current law by persuading higher courts to reconsider recent decisions or reflect on the current interpretation of law. Appellate decisions are powerful and can have an immediate and lasting impact in society, this state, or even the entire country.
Appeal deadlines are time-sensitive, so please don’t delay.
What Types of Cases Can Be Appealed?
Types of cases that can be appealed cover a wide range of legal matters; examples include:
- Civil – Commercial litigation, contracts, property disputes, consumer protection, employment law, personal injury, malpractice, and more.
- Family – Divorce, custody or visitation, alimony, child support, paternity, post-judgment modifications and orders, and more.
- Criminal – Cases involving insufficient evidence for conviction, improper admission of evidence, plea or sentencing concerns, or many other errors in the adjudication process.
These are just a few types of cases that can be appealed. Litigation covers a broad spectrum of legal disputes we can help to overturn or defend.
What Does the Process Involve?
The process of appealing decisions made by lower courts varies depending on the case, but may involve:
- Reviewing records of lower court proceedings, including judgments, transcripts, evidence, and legal arguments made by counsel or self-represented parties.
- Adequately preparing or preserving issues prior to appeal through post-judgment motions to the trial court.
- Researching legal issues and drafting briefs that set forth legal arguments in support of your position, which often constitutes the most time-consuming portion of an appeal.
- Addressing the higher court directly during oral argument to further explain our legal position and answer any questions the judges may have.
